About the Notarial Act
 

A Notary Public's responsibility is to identify and deter fraud as an impartial witness to a legal proceeding. They also make sure that the person signing the document knows what they are signing, understands the action being taken and verifies that the signature on the document is the person signing the document.


Beyond the Notary Public is a Notary Signing Agent. This Notary is specifically trained to facilitate Real Estate mortgage closings. The Notary Signing Agent is contracted with mortgage lenders, title firms and escrow companies to make the loan closings as convenient as possible for the borrowers by obtaining the necessary loan documents, signatures, notarization of any documents and delivering any settlement checks.


It is our practice to make the signing of all documents as efficient, convenient and comfortable as possible while maintaining a professional atmosphere that is ethical, and error-free.


A Notary Public is not an attorney and by law, cannot explain or describe the contents of any document otherwise it would be considered the unauthorized practice of law which could have legal penalties attached. Should you have any questions or concerns about the contents of any documentation, they should be addressed to the issuing party (lender, title company) or an attorney.


In addition, a Notary is not authorized to suggest which Notarial certificate to use for each signing so it is highly recommended that the requester know in advance which notary act is being requested.
